Anyone who know's about...

Car accidents and lawyers and courts and stuff..over the weekend me and my girl were rearended by some dumb smucks who couldnt drive..so our hole rear end on our new car is fuckin wrecked and we were looking to pursue some kind of lawsuit in order to cover the medical bills and the damage's on the car..what are the chances that some kind of money would come out of it?..should i sue?...what would yall do if this happen to you?..and if it ever did happen to you what was the outcome??

well actually insurance is supposed to cover your vehicle and medical bills.. depending on both of your insurance coverage, first talk to your insurance company..

if he doesn't have insurance nine times out ten he doesn't have the money to pay is you sue him

Yeah thats what we were already told..we been to the hospital twice and both of us have a pretty hefty bill..my girl got x-rayed on her back and such and both time i went they gave me 2 vics a piece..thats not alot of meds but im sure it adds a lil chunk to the bill..

everyone i know is tellin me that they're insurance will pay for it all but i can also sue the driver as an individual because the car she was driving was borrowed from one of her family members..


then to top it all off..i prolly have a lawsuit with the car dealer that i bought the car from because none of my air bags went off..



anyone else have any pointers or opinions..

Court will only make you whole. You can only sue for whatever you're out (if anything) AFTER the other person's insurance + your insurance kicks in. Some jackass rear ended our old car (a Rav 4) while my wife was driving (with our fucking son) back in 2004. That guys insurance paid for EVERYTHING including a rental car while our car was in the shop. So in the end we were out nothing. We were made whole. If after everything is said and done you're not even or whole, THEN you can sue for those costs. But you can't break even and then try to sue for MORE money. Accidents aren't windfalls or get rich quick schemes.

Also, when you get a settlement check from either your insurance, or the other persons insurance, REMEMBER: if you accept that, you're agreeing to release that other person AND their insurance co. from further penalties. Meaning once you accept the settlement you have ZERO ground to then afterwards pursue those people or their insurance in court. Don't matter if you never even cash the check.. you'll get a form with the check that you have to sign in order to GET the check. Once you sign that, that's ALL you get. So make sure you're straight (financially) BEFORE you settle.

damn i had no clue about none of this.. i mean i figured i couldnt get a big check for it and thats what i was telling everyone..that i basically will only break even but from what ive heard car accidents in no fault are a minimum of 10 g's..but then again if i get 10 gs i wont even have half of what im needed for all the bills..so i guess we'll see what happens..but in the same aspect..he will not only have to pay fees of rental cars and fixing my car..but..

i can sue for..

my time out of work,medical bills,and any other realated physical or mental stresses caused during or after the accident..

understand that with what happened with your airbags failing to deploy is a seperate matter that you will have to have proof of for instance pictures of the the airbag systems in tact the quote not havent deployed airbags as a repair and evidence that the force your part of the car was hit with should have deployed them... with the check you will not recieve a check until you've reached a settlement, so as long as all of your bills will be covered it is fine to accept the check.. but if you want to sue for grievance due to injury you will have to fork out some cash and get a lawyer

I understand that the airbags is a seperate case and thats not something im gonna pursue any time soon..but these people will pay for my car and every thing else for sure..
