Re: Anyone who know's about... Court will only make you whole. You can only sue for whatever you're out (if anything) AFTER the other person's insurance + your insurance kicks in. Some jackass rear ended our old car (a Rav 4) while my wife was driving (with our fucking son) back in 2004. That guys insurance paid for EVERYTHING including a rental car while our car was in the shop. So in the end we were out nothing. We were made whole. If after everything is said and done you're not even or whole, THEN you can sue for those costs. But you can't break even and then try to sue for MORE money. Accidents aren't windfalls or get rich quick schemes.
Also, when you get a settlement check from either your insurance, or the other persons insurance, REMEMBER: if you accept that, you're agreeing to release that other person AND their insurance co. from further penalties. Meaning once you accept the settlement you have ZERO ground to then afterwards pursue those people or their insurance in court. Don't matter if you never even cash the check.. you'll get a form with the check that you have to sign in order to GET the check. Once you sign that, that's ALL you get. So make sure you're straight (financially) BEFORE you settle. |
